MATHEWS, Va. (WAVY) — A Mathews County youth leader accused of sexually abusing a 15-year-old at a local church will be back in court in August.
36-year-old Kenneth Scott Marshall appeared before a judge Wednesday morning.
A grand jury indicted him last week on charges of aggravated sexual battery of a minor through the use of mental incapacity or physical helplessness and forcible sodomy of a minor through the use of mental incapacity or physical helplessness.
Law enforcement arrested Marshall during a traffic stop on July 16 in connection to the allegations, which were investigated over a month-long period, according to the Mathews County Sheriff’s Office.
Investigators say they conducted multiple interviews that substantiated the allegations against Marshall.
The victim has an intellectual disability and was supposedly on sleep medication at the time of the incident, according to court documents.
Marshall’s attorney asked for a motion to delay Wednesday’s hearing so investigators could take a look at evidence on Marshall’s cell phone.
Court documents reveal investigators took the phone they believe Marshall used to make arraignments with the victim to spend the night at his home before the forced sex act was committed.
Documents also state that investigators are looking at the phone to check if there is any child pornography on it.
Marshall is being held at the Middle Peninsula Regional Security Center without bond and is expected back on court on August 22.
