A Vermont state representative has been accused of driving under the influence following a traffic stop in Montpelier early Wednesday.

Montpelier police say officers pulled over a car driven by Rep. James Carroll, a Democrat from Bennington, in the Capitol Complex parking lot at about 8:24 a.m. because of “an excessively loud muffler.”

During the traffic stop, Carroll allegedly showed signs of alcohol impairment, police said. Carroll refused to take field sobriety tests, police said he provided a breath sample that showed that his blood-alcohol content was above the legal limit.

Carroll was subsequently taken into custody for suspicion of DUI and later released with a citation to appear in Washington County Criminal Court on March 7.

Carroll was elected to represent Bennington’s 5th District in November 2022. His term ends in January 2025.
