VIRGINIA BEACH, Va. (WAVY) — A woman already facing several charges after police allege she drove an ice cream truck drunk is in more trouble after skipping her hearing Thursday.

35-year-old Ellaine Durham was arrested in July on the initial charges of DUI and three counts felony hit-and-run. Police said Durham was driving an ice cream truck when she hit another car in Sandbridge, injuring three people.

After the incident, the judge granted her a conditional bond so she could attend a recovery program, with implicit instructions to return to jail upon completion. The Commonwealth’s Attorney’s Office says Durham never showed up to the program, therefore the Commonwealth revoked her bond. 

The Commonwealth nolle prossed, or withdrew, the initial charges so they can now charge her additionally with failure to appear. They intend to direct indict her on the DUI, hit-and-run and the new failure to appear charges.
