WASHINGTON (NEXSTAR) — President Joe Biden’s student loan forgiveness program, comes to a halt.

“The latest Biden student loan forgiveness scheme, is illegal,” Kansas Attorney General Kris Kobach said.

Kobach led this multi-state effort.

“This is transferring $475 billion of debt from these students to the American taxpayer, and only Congress can do that. That was at the core of both of these decisions rendered in federal district court,” Kobach said.

The President’s “SAVE” plan eliminated debt for some and lowered monthly payments and loan terms based on a borrower’s income. 

The judge’s rulings prohibit the Biden administration from moving forward with the plan. 

Zack Smith with the Heritage Foundation says the program was unfair.

“To many of the workers who either did not take out student loans or repaid, their student loans in the process,” Smith said.

Democrats say this program is a fair standard helping millions of Americans.

“The Attorney General is wrong,” Sen. Kirsten Gillibrand (D-N.Y.) said.

Gillibrand argues that since the program is based on a borrower’s ability to pay, it is appropriate, especially for those who choose to do service jobs.

“Those are among the lowest paid careers there are. And so when our students choose to serve our nation as opposed to make the big bucks, we should reward them,” Gillibrand said.

In a statement, the White House said these rulings “won’t stop our Administration from using every tool available to give students and borrowers the relief they need.”

The White House also said the Department of Justice would work to defend the plan.
