HAMPTON, Va. (WAVY) — A Hampton family is mourning the loss of 35-year-old Latonya Foster, who was killed by someone suspected of driving under the influence early Saturday morning.

Foster’s close friend, Johnathan Lynch, was on the phone with Foster as she drove east on Interstate 64 near Settlers Landing Road. He was the last person to speak with her.

“It just doesn’t make any sense; this is not fair,” Lynch said during a tearful interview at the home of Foster’s parents. “She was so beautiful. We’re not just talking about the look of her. We’re talking about who she was as a person.”

Too distraught to speak on camera, Foster’s parents appointed Lynch as a spokesperson for the family.

Police say just before 1:30 a.m. Saturday, Theresa Tann, 52, entered the wrong lane of travel from Settlers Landing Road and crashed head-on into Foster, who was traveling eastbound on I-64. Lynch heard the crash.

“I heard a breath and then I heard people knocking on the window and I’m calling her name like ‘Tonya, Tonya,'” Lynch said. “So I knew something immediately was wrong because she wasn’t responding to me. I heard her take her last breath. For somebody to come on on the opposite side of the road, it’s just ridiculous.”

Loved ones shared video and still pictures of the shattered remains of Foster’s car. It’s their way of presenting an indelible image of what can happen when an intoxicated person is behind the wheel of a car.

“It’s just — it’s very unfortunate that that car is beyond totaled,” Lynch said. “You can’t even recognize what type of car it is when you look at it.”

Lynch responded to the scene, where he saw good Samaritans who stopped to help in the aftermath of the horrific crash.

“I just want to say thank you to the young lady, and the lady that tried to render aid and a young man that tried to get her help,” Lynch said. “I just appreciate it. They were Good Samaritans. They did a good job.”

Lynch remains grateful for the support Foster provided nearly four years ago when his cousin, Donovan Lynch, was shot and killed by a Virginia Beach police officer. Lynch, a Norfolk-based trauma counselor, is offering a helping hand to the entire community.

“I’m hoping to start a nonprofit in her memory to make sure that people know the seriousness of drunk driving,” Lynch said. “So we hope to start a nonprofit in her name and continue her legacy going forward.”

Days after the fatal crash, Tann has been charged with involuntary manslaughter, first offense driving while intoxicated and driving while license was suspended/revoked.

She suffered non life-threatening injuries. Virginia State Police say Tann will be charged with driving under the influence and manslaughter.

Foster’s funeral arrangements are pending.
